Theft Penalties Under Texas Law
The punishment for theft depends upon the circumstances of each case. The most important factor is the value of the items stolen.
- Less than $50: Class C Misdemeanor (maximum $500 fine)
- $50 – $500: Class B Misdemeanor (maximum 180 days in jail)
- $500 – $1500: Class A Misdemeanor (maximum 1 year in jail)
- $1500 – $20,000: State Jail Felony (maximum 2 years in state jail)
- $20,000 – $100,00: 3rd Degree Felony (maximum 10 years in prison)
- $100,000 – $200,000: 2nd Degree Felony (maximum 20 years in prison)
- $200,000 or more: 1st Degree Felony (maximum life in prison)
